DMCA Copyright Infringement Notification Policy for Africa Talks Business

Africa Talks Business respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, Africa Talks Business will respond expeditiously to claims of copyright infringement reported to our designated copyright agent.  

This policy outlines the procedures for submitting a DMCA takedown notice and the process for submitting a counter-notice if your content has been mistakenly removed.

A. Procedure for Reporting Copyright Infringement (Takedown Notice)

If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted material has been posted, stored, or transmitted via the Africa Talks Business Services (including our website www.africatalksbusiness.com, any associated mobile applications, social media platforms, and other services) in a way that constitutes copyright infringement, please submit a written notification (a “DMCA Takedown Notice”) to our Designated Copyright Agent.

Your DMCA Takedown Notice must include substantially the following information:

  1. Identification of the copyrighted work claimed to have been infringed: Please provide a specific description of the copyrighted work that you believe has been infringed. If multiple copyrighted works are covered by a single notification, please provide a representative list of such works at that online location.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Africa Talks Business to locate the material: Please provide the exact URL (web address) or other specific identifying information of where the material that you claim is infringing is located on the Africa Talks Business Services. Providing screenshots may also be helpful.
  3. Information reasonably sufficient to permit Africa Talks Business to contact the complaining party: Please include your full legal name, mailing address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law:  
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed:  
  6. The physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.  

B. Procedure for Submitting a Counter-Notice  

If you believe that material you posted that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice to our Designated Copyright Agent.  

Your counter-notice must include substantially the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled: Please provide the exact URL (web address) where the material was located before it was removed or access was disabled.  
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.  
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Africa Talks Business may be found), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

C. What Happens After We Receive a Valid Takedown Notice

Upon receipt of a valid DMCA Takedown Notice, Africa Talks Business will take the following steps:

  1. Expeditiously remove or disable access to the allegedly infringing material.
  2. Take reasonable steps to notify the user who posted the material that it has been removed or access to it has been disabled.

D. What Happens After We Receive a Valid Counter-Notice

Upon receipt of a valid DMCA Counter-Notice, Africa Talks Business will:

  1. Provide the complaining party (the original copyright claimant) with a copy of the counter-notice.
  2. Inform the complaining party that we may reinstate the removed material or cease disabling access to it in ten (10) to fourteen (14) business days following receipt of the counter-notice, unless our Designated Copyright Agent has received notice from the complaining party that an action has been filed seeking a court order to restrain the alleged infringer from engaging in the infringing activity relating to the material that was removed or disabled.  

E. Repeat Infringers

It is Africa Talks Business’s policy in appropriate circumstances and at its discretion to disable and/or terminate the accounts of users who are repeat infringers.  

F. Modifications to this Policy

Africa Talks Business reserves the right to modify this DMCA Copyright Infringement Notification Policy at any time without notice. You are responsible for reviewing this policy periodically for any changes.
